AnthonyM83 Posted January 14, 2009 Share Posted January 14, 2009 I guess the problem I have is that they are being charged with creating and dispersing photos of minors, and if that is true, as the pictures are of themselves, can you be held responsible as a minor? Yet if they've decided they are close enough to adulthood to charge as such, then shouldn't they be allowed to dispurse their pics as they choose? Seems like a paradox, but I'm not big on law stuff... It's messed up. I think the law only says it's illegal to create or have possession or disperse child pornography without mentioning whether it's your own picture or how old you are. Reminds me of CA's sexual intercourse law. It's illegal to have sex with a minor, period. No exceptions for if you're a minor of the same age. Should there be an investigation into what the girls did and the guys having the pictures? Yea sure... scare the hell out of them or do what you can to convince them of the dangers of this. As well make sure the boys didnt start sending these photos out to other people. Should the school employees have gone through the phone in the first place? Absoloutley not! Damn it even as a licensed security officer I am not allowed to search a persons belongings without consent. Company property on the other hand (like a school locker) is understandably a different story. Not to mention there is no reason for them to look through the phone... if its believed the phone may have some information on it thats potentially harmfull to others, be it these photos or even threats against a person... thats what you call the police for!!! I have always believed, especially in recent times that theres way to much power in the school system. As a trained and certified healthcare provider I cant even say the patient has a broken leg, its outside of my scope of practice.... but at one point they wanted to make it legal for school teachers to diagnose ADD and ADHD!? I dunno if they are trying to send a message to the students, or they really believe the charges are appropriate... As for if an adult sends naked pictures, then it is not considered pornagraphy, just nude pics. The whole "child porn" act is designed to enforce internet and other stuff, and is specifically for children under 18 years old..... My guess is that this will all be plead out dismissed dropped down, gotten rid of ...etc. ...... I do not see convictions in this case.... from what appears to be foolish teenage horseplay... Now if the boys had been peeking thru a hole in the wall and took photos of the girls w/o permission, I could see the whoel child pron thing sticking.... Just my thoughts as a seasoned cop. Well can you you really just open up for once and tell us how you really feel? I do think some children have disorders that can affect behavior and learning. But I am positive these labels are used way to often for kids that have not been disciplined enough. As to OP I hope the justice system is just trying a scared straight approach and will eventually drop these idiotic charges. Otherwise these kids will be ruined for life. They will have to register as sex offenders for all eternity. It will cost tax payers money for all eternity as these kids will never be able to be productive citizens. Someone somewhere want alittle attention and Im not thinking its the kids they have had enough. Some people really need to learn how to think outsid the box and let alittle common sense in. :? I'd take a daily beating if it allowed me to stay concentrated on book work for longer periods of time. Not even kidding, I'd take the pain and bruising to have the reading attention span of some of my friends. I agree with you bro. It is another pretty asinine statement with no validity to it. While I myself do not suffer from ADD/ADHD, my significant other does. Through medication, I have watched her go from a very scatter brain type person to one being able to sit and focus on tasks and actually complete them. The days she forgets to take her medication I get a reminder of what used to be. My youngest daughter is exhibiting similar traits and we are keeping a watchful eye on her. We are not resorting to medications as her type of ADD is more of the easily distracted type, not acted out in behavior like the males who are afflicted. From my reseach, I am aware that there are 6 disctinct classifications of ADD/ADHD and no it is not a crock. My wife was not diagnosed until her mid-late 20s, she was simply overlooked through her school years. Her case was nothing even close to needing a kick in the ass or whatever spew crotch threw forth. I do believe it is a condition that is overdiagnosed sometimes, but it is not a result of parents not tending to their young with corporal punishment.
