Well, who's a member of the militia then? From the United States Code (USC),

§ 311. Militia: composition and classes

(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.

(B) The classes of the militia are—

(1) the organized militia, which consists of the National Guard and the Naval Militia; and

(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

Additionally, at least in terms of ownership for protection, please see District of Columbia vs Heller (federal land) and McDonald vs Chicago (incorporated the second amendment against the states).

As such, the right to bear arms is an individual right based on SCOTUS case law. Regardless, even if it was tied to the militia, any male between 17 and 45 is, by law, a member of the militia.

All of this type of crap is happening more and more in out society. I have nothing against owning a gun but at least have the smarts to know how to take care of one. Just because you are allowed to have one doesnt mean you should. Its like just because you can have a baby dosnt mean you should........

All of this type of crap is happening more and more in out society. I have nothing against owning a gun but at least have the smarts to know how to take care of one. Just because you are allowed to have one doesnt mean you should. Its like just because you can have a baby dosnt mean you should........

What I see is two anecdotal stories involving deaths due to massively bad judgment. In my region alone there's ususally multiple traffic fatalities a week due to, you guessed it, masively bad judgement. When someone can show me an argument about guns that doesn't involve anecdotal stories and the resultant fear, I MIGHT listen....

I understand that every childhood loss of life is a tragedy. No one would ever dispute that. But gun regulation is not the answer. I reference the works done by Lott, that time and time again it shows that gun control solves nothing. The Brady campaign is a huge anti-gun advocate here in the US, and in a paper I wrote this spring, I discovered far more fear mongering than hard science behind any of their studies. Do I think that there are irresponsible gun owners out there and that guns are misused/mis-stored? Absolutely. But to make a legal adult jump through hoops to exercise a constitutionally given right is off base. If we can teach evolution, sex ed, and other controversial things in school, why can't we teach a proper firearms respect in the same manner. I was a member of the National FFA organization in high school and was a Trap shooter. Proper usage through education...

So when they use bad judgment in the driving fatalities do their drivers licences get taken away ? So if they use bad judgement in shooting fatalities do their guns get taken away? If it is a constitutional right to have guns does that make it different? As far as Im concerned is it the fear that make you guys carry guns. Guns are not the answer but since you have the right to carry them don't you think its a good thing to have education behind it. Like I said just because you can dosnt mean you should.

Education is the key in alot of things and its your country so do what you guys want but I put those news artical out their because even though you have that right to carry guns there are always going to be stupid people that miss use it.

And fire you completely missed the point of it but to tell you the truth if zipper pants killed people maybe they should be banned.

Just to re-touch on this, one month later. Remember Rep. Giffords who was shot at a Parking Lot. The guy who shot her, has been ruled by the Judge that he is unfit to stand trial. What?!? He was fit to buy the guns. He was fit to attend College. This is just one of the reasons, we need Gun Regulation...

In NYC, it does. If NYC had a low violent crime rate, I might understand where you're coming from.

What is the rate of murder in NYC committed with lawfully possessed guns? Pretty damn small. So how's that "regulation" working out for ya?
